Power Gripps USA, Inc. d/b/a Versa Gripps (“Company” or “Versa Gripps” or “we”) is a performance training brand devoted to making innovative, high-quality grip and lifting accessories for athletes and fitness enthusiasts. Our “Services” are made up of the versagripps.com website, mobile apps, products or programs offered by Versa Gripps. This Privacy Policy explains how we collect, use, and disclose information about you when you visit or use our site, online or offline products and services, or otherwise interact with us.

This Privacy Policy explains how Versa Gripps and its affiliates collect, use, and disclose information about you when you use our sites, mobile and tablet applications, and other online products and services that link to this Policy, subscribe to our emails and newsletters, attend our events (“Products”) or otherwise interact with us.


WHAT YOU AGREE TO BY USING OUR SITE OR SERVICES

By using the Services and providing us with Personal Information, you agree to the practices described in this Privacy Policy and the Cookie Policy and our Terms and Conditions, and to the updates to these policies posted here from time to time. This does not mean that all examples of that category of Personal Information were in fact collected but reflects our good faith belief to the best of our knowledge that some of that information may have been collected about consumers. A. Identifiers. A name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account username, screen name, password, or other similar identifiers.

B. Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)). A name, signature, Social Security number, address, telephone number, bank account number, credit card number, debit card number, or any other financial information. Some personal information included in this category may overlap with other categories.

C. Protected classification characteristics under California or federal law. Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression), sexual orientation, veteran or military status.

D. Commercial information. Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

E. Biometric Information. Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as fingerprints, faceprints, and voiceprints, or other physical patterns.

F. Internet or other similar network activity. Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement, including user generated content.

G. Geolocation data. Physical location or movements.

H. Sensory data. Audio, electronic, visual, thermal, olfactory, or similar information.

I. Professional or employment-related information. Current or past job history or performance evaluations.

J. Inferences drawn from other personal information. Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.


Video Viewing Behavior

Your video viewing activity, including information as to whether you requested or obtained specific video materials or services, may be collected and shared by Versa Gripps with third parties, including, without limitation, service providers with whom we partner to provide our Products to you, as well as our advertising, social media and other business partners. By using our Products where videos are displayed, you consent to the collection and sharing with third parties of your video viewing activity, if any, with each such consent being valid for two years from the date of such use or until you withdraw your consent.


A Note on Sensitive Personal Information

Sensitive Personal Information is broadly defined under different data privacy laws and may include: racial or ethnic origin; political opinions; religion or other beliefs; health, biometric or genetic characteristics; trade union membership; sexuality (information about your sex life or sexual orientation); any criminal background; precise geolocation; and the content of your private communications (other than messages you may send to us).

Versa Gripps does not wish to collect most categories of Sensitive Personal Information. We will only collect sensitive personal information for the purposes and in the manner allowed by law or with your consent, where permitted by law. Consistent with applicable law, you may limit certain uses or disclosures of your sensitive personal information by contacting us at privacy@versagripps.com.


HOW WE COLLECT YOUR INFORMATION

Generally, there are three ways we collect your information: (A) Information You Provide to Us, (B) Information We Automatically Collect, and (C) Information We Collect from Other Sources.


A. Information You Provide to Us

We may collect the following information you provide to us directly when you:

Use our Site: When you come to our Site, we may automatically collect certain information, including usage information (pages visited, order visited, hyperlinks clicked), video viewing information, and location information. We may be able to determine from an IP address a user’s Internet Service Provider and their geographic location. Some of our apps can provide content based on your GPS location if you enable this feature. Your GPS location is your precise geolocation, which is considered a type of sensitive personal information.

Engage with Us Online: We may collect information you provide when you register an account with us or sign up for a service; subscribe to a newsletter or purchase a product; or participate in a contest, promotion, or survey. This information may include contact information (name, email address, postal address, telephone number), demographic information, account credentials, payment and transaction information, and communication preferences.

Engage with Us via Chat: You may engage with us through our chat functions. We may deploy a chatbot or other functionality on our sites for customer service or other business purposes. By using the website and engaging with the chatbot or chat function, you consent to the recording and use of information about you and the chat session. You further agree that we may use or disclose the information you provide via the chatbot or chat function in accordance with this Privacy Policy.

Submit Content to Us: We offer the ability to post content in certain contexts, or to share information with us held on other platforms, including user-generated content, photos or videos you upload to the Site, and data held by you on social media platforms.

We may create or generate new information about you from other data we collect, including using automated means to generate information about your likely preferences or other characteristics (“inferences”). We also use cookies, web beacons, and similar tracking technologies when you visit our Site.

USE OF YOUR INFORMATION BY VERSA GRIPPS

Versa Gripps, including its brands and corporate affiliates, may use your information consistent with applicable law and choices and controls available to you, including for the following purposes:

  • To provide you Products and Services, including completing payments and transactions, and resolving technical issues.

  • To contact you, including providing service-related messages, responding to customer service inquiries, sending emails and newsletters, and notifying you of promotions, contests, surveys, or events.

  • To improve or develop our products and services, including through automated analyses, training AI/ML models to predict user preferences, and assessing customer satisfaction.

  • To market and advertise our Products or Services to you, including through targeted or promotional emails and digital advertising.

  • To customize and evaluate your experience, including through ad-tracking technologies, building demographic models, and affiliate links.

  • For legal reasons or to carry out administrative tasks, including auditing internal processes, security, and fraud detection.

  • With your consent, for other purposes as you may direct.


We will not sell reviews or analyses of chat communications. Every Man Versa Gripps uses cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart, and this information is used to determine when to send cart reminder messages via SMS. You may opt-out or control your choices as described in the “Your Rights” section, below.


SHARING YOUR INFORMATION WITH OTHER ENTITIES

We may share your information as follows:

  • Within our company: We may share your information with affiliates and others within our corporate family.

  • With Service Providers: We work with service providers to carry out tasks including processing payments, e-commerce fulfillment, technology infrastructure, hosting websites and apps, customer service, targeted advertising, fraud prevention, shipping, and email/SMS distribution.

We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign.

Right to Access: Consistent with applicable law, you may submit a verifiable consumer request to access your personal information in a portable and readily usable form, as well as information about our data practices.

Right to Correct: Consistent with applicable law, you may submit a verifiable consumer request to correct inaccuracies in your personal information held by Versa Gripps.

Right to Delete: Consistent with applicable law, you may submit a verifiable consumer request to delete your personal information.

Sale and Sharing of Data: We do not sell personal information to third parties; we are not data brokers and do not put personal information on the open market. We do not knowingly sell or share the personal information of individuals who are younger than 17. We do allow third parties to collect personal information through the Versa Gripps Platform for the business purposes described in this Privacy Policy. Consistent with applicable law, you may opt out of such processing by emailing us at privacy@versagripps.com.

Right of Non-Discrimination: We will not discriminate against you for exercising your rights and choices, although some functionality and features may change or no longer be available to you.


Data Retention

We retain personal information for as long as needed or permitted in light of the purpose(s) for which it was collected, including for the length of our ongoing relationship with you, legal compliance obligations, and as permitted by applicable statutes of limitations or regulatory requirements.


Do Not Track and Global Privacy Settings

Other State Rights – California

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits consumers who are California residents to request, once a year, free of charge, information about the categories of personal information we disclosed in the preceding calendar year to third parties for those third parties’ direct marketing purposes. Additional Information for Colorado Residents

We offer our customers a loyalty program that provides certain perks, such as rewards and exclusive offers. We may also provide sweepstakes, contests, or other promotional campaigns (collectively, the “Programs”). Because our Programs involve the collection of personal information and offering of certain benefits, they might be interpreted as a “bona fide loyalty program” under Colorado law. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES WILL WE OR OUR SUBSIDIARIES, PARENT COMPANIES, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM OUR USE OF PERSONAL INFORMATION, AND THE MAXIMUM AMOUNT OF DAMAGES FOR WHICH WE WILL BE LIABLE UNDER THIS AGREEMENT WILL BE THE GREATER OF THE FEES YOU PAID FOR ANY PRODUCT IN CONNECTION WITH WHICH YOU PROVIDED YOUR PERSONAL INFORMATION, OR $100.


Indemnification: You agree to indemnify and hold harmless Versa Gripps, its affiliates, and each of their respective directors, officers, managers, employees, shareholders, agents, representatives, and licensors, from and against any losses, expenses, damages, and costs, including reasonable attorneys’ fees, that arise out of your provision of any inaccurate or unauthorized Personal Information to us or your violation of this Agreement or any rights of another.


Choice of Law: This Agreement will be governed by and construed in accordance with the laws of the State of Maine, without giving effect to any principles of conflicts of law.


Statute of Limitations: To the extent permitted by applicable law, any claim or cause of action arising out of or related to use of the Products or this Agreement must be filed by you within one year after such claim or cause of action arose or be forever barred.


WAIVER OF CLASS ACTION CLAIMS

This is an important section that limits your right to bring a class action against us. You and Versa Gripps agree that each party may bring disputes against the other party only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding, including, without limitation, a federal or state class action lawsuit. However, nothing in this section limits your right or Versa Gripps’ right to bring a lawsuit as an individual plaintiff. This provision applies to the maximum extent permitted by applicable law to all claims that arise under, in connection with, or relate to this Privacy Policy or the Personal Information you provide to us.
